WARRANTY, DISCLAIMER AND LIABILITY

As the industry standard, the non-release binding system is not designed to release during a fall. The rider should be aware of the possibility of body injury, especially when negotiating dangerous terrain or riding on non-snow surfaces. Any use of our snowboards and snowboard accessories on non-snow surfaces will completely void all warranties and render all warranties invalid.

As there is an inherent risk in all alpine snow sports, Mash Snowboards™ are to be ridden at the rider’s own risk. It is the rider’s responsibility to familiarize him/herself with the product, the terrain, and ski area safety codes, and to receive adequate and professional instructions/training. Mash Snowboards™, its employees and its affiliates can not be held responsible for injuries, loss of limb or life, property damage or injury to others due to the use of our sports equipment and accessories. By purchasing Mash Snowboard™ products you agree that you assume all risk associated with the use of our equipment and assume the risks that are inherent to all the sports that we are associated with.

Mash Snowboards™ has a 10 day satisfaction guarantee from the time you receive your new sport board product/s. If for any reason you are not happy with your products, and the product has not been used and is in the original condition and packaging, Mash will refund the purchase price of the product in full. Return shipping to be paid by the purchaser and restocking fee will apply.

Mash Snowboards LLC™ warrants its products to be free from defects in material and workmanship for thirty six (36) months from the date of the original customer purchase. This warranty is valid for the original retail purchaser only and is non-transferable. All warranty claims must be accompanied by a copy of the original retail receipt as proof of the purchase.  The warranty is subject to the following limitations, and does not cover: 

·        Normal wear and tear, including: chips, scratches, abrasions, discoloration or fading from use or exposure to the environment. 

·        Punctures or blow-outs of the air bladders due to sticks, rocks, non-snow surfaces, impact and debris.  

·        Damage caused by misuse, abuse, impact, neglect, accident, lack of maintenance, alteration, repair by unauthorized persons or any damage as a result of riding on a non-snow surfaces. 

·        Improper mounting or adjustments of bindings including drilling through the deck or p-tex base (the very bottom of the snowboard), or incorrect hardware on Mash Snowboards™. 

·        Mash Snowboards™ products not purchased from an authorized Mash Snowboard™ dealer.

·        Any Mash Snowboard™ products resold by the original retail customer, including resold rental, demo and team equipment. 

·        Consequential damages, incidental damages, or expenses, including damage or injury to a person or property. 

·        Any costs, losses or damages incurred as a result of loss of use of product (including stomp pads and stickers). 

·        Any non-warranty repair work. In the unlikely event that a product defect is suspected, contact an authorized Mash Snowboard™ Dealer.

The damaged product should be carefully packaged and returned to the dealer (i.e., in the case of damage to the board, remove and retain bindings). Risk of loss shall remain with the owner until actual receipt of product by Mash Snowboards LLC™. Your proof of purchase must be included to validate warranty. Goods returned to Mash Snowboards LLC™ or returned by an authorized dealer will be inspected to determine if the condition is warrantable  according to Mash Snowboards LLC™ warranty guidelines. Unfortunately, we can not make warranty decisions over the telephone or with photo’s. Returning the product does not indicate that the product is under warranty or that it has a warrantable defect.  If the product is warrantable, Mash Snowboards LLC™ will determine, at it’s own discretion, whether the product should be repaired or replaced. The product will be returned freight prepaid to the dealer or original purchaser within a reasonable time period. Any warranty repair or replacement of product by Mash Snowboards LLC™ will be covered by this warranty for the remaining, unexpired portion of the original warranty period, which is thirty six (36) months from the original date of  purchase. If the product is not covered under the terms of this warranty, or if it is not accompanied by the proof of purchase, it will be returned to the sender freight collect. 

All warranties implied by state or provincial law, including warranties of merchantability and fitness for a particular purpose, is hereby limited in duration to the duration of this limited warranty. Some states and provinces do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply to you. With the exception of any warranties implied by state law as hereby limited, the foregoing express limited warranty is exclusive, and, in lieu of all other warranties, guarantees, agreements, and similar obligations of manufacture or seller. Authorized Mash Snowboard™ dealers do not have the authority to alter, modify, or in any way change the terms or conditions of this warranty, nor do they have the authority to deem a product warrantable. To the extent that any provision of this warranty is prohibited by federal, state, provincial or local law and cannot be preempted, it shall not be applicable.
